1. Acceptance of Terms

By accessing or using Bespoke (the "Service"), operated by The Bespoke Team ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and The Bespoke Team.

2. Description of Service

Bespoke is an AI-powered mobile app generation platform. You describe an app in natural language, and our AI generates a structured app specification that is rendered within the Bespoke container app on your mobile device. Generated apps are not standalone applications; they run exclusively within the Bespoke container app.

The Service includes the Bespoke mobile application, the AI generation pipeline, runtime AI features (such as text extraction and image classification), and integrations with third-party services that you choose to connect.

3. Account Registration

Access to the Service currently requires an invitation. You may not create an account without receiving an invitation from us. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You must provide accurate and complete information when creating your account. You may not create an account on behalf of another person without their permission, and you may not create multiple accounts.

4. Acceptable Use

You agree not to use the Service to:

• Generate apps that contain harmful, illegal, abusive, defamatory, or obscene content.
• Generate apps that violate Apple App Store or Google Play Store guidelines.
• Attempt to reverse-engineer, decompile, or otherwise extract the source code of the generation pipeline, component library, or any other proprietary part of the Service.
• Interfere with or disrupt the Service, its servers, or the networks connected to the Service.
• Use the Service to collect personal information about other users without their consent.
• Circumvent any access controls, rate limits, or security measures of the Service.
• Use the Service in any manner that could damage, disable, overburden, or impair the Service.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use provisions.

5. Intellectual Property

5.1 Your Content

You retain ownership of the natural language descriptions you provide and the app specifications generated from those descriptions ("Your Content"). By using the Service, you grant us a limited license to process, store, and display Your Content solely for the purpose of providing the Service to you.

5.2 Our Platform

We retain all rights, title, and interest in the Bespoke platform, including the container app, component library, rendering engine, generation pipeline, AI models and prompts, and all associated intellectual property. Nothing in these Terms transfers ownership of any part of the platform to you.

5.3 Generated Apps

Generated apps run exclusively within the Bespoke container app. While you own the app specifications, the apps themselves depend on our proprietary rendering engine and component library to function. You may not extract generated apps for use outside the Bespoke container.

6. Third-Party Integrations

The Service allows you to connect third-party services, such as Google Sheets, to your generated apps. When you connect a third-party service:

• You are responsible for your own third-party service accounts, API keys, and credentials.
• You must comply with the third-party service's terms of use and privacy policy.
• We are not responsible for the availability, accuracy, or security of third-party services.
• You may revoke third-party access at any time through the integration settings or through the third-party service's own settings.

7. AI-Generated Content

Apps generated by the Service are created using artificial intelligence. You acknowledge and agree that:

• AI-generated apps may contain errors, inaccuracies, or unexpected behavior.
• We do not guarantee the accuracy, completeness, or fitness for any particular purpose of generated apps.
• You are responsible for reviewing and testing the behavior of generated apps before relying on them for any important purpose.
• AI generation results may vary; the same description may produce different results at different times.
• We do not guarantee that the AI will be able to generate a functioning app from every description.

8. Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. During the current beta period, the Service may experience downtime, data loss, or changes without prior notice. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

9. Limitation of Liability

To the maximum extent permitted by applicable law, The Bespoke Team and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or in connection with these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Bespoke Team and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Termination

Either party may terminate these Terms at any time. You may terminate by ceasing all use of the Service and requesting account deletion. We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice.

Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by contacting us at admin@gobespoke.ai. We will delete your personal data within 30 days of your request, except where retention is required by law.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms within the app or by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in the State of Delaware.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Bespoke Team regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
